OVERVIEW
The Supreme Court of Canada has recently addressed some fundamental aspects of the judicial review of the exercise of regulation-making powers, including the applicability of the standard of review analysis and the threshold for overturning regulations on purposive bases. Auer v Auer and TransAlta Generation Partnership v Alberta are the Court’s most significant decisions in this regard since Katz v Ontario over 10 years ago, if not earlier. This webinar will comment on these developments and where they may lead.

John Mark Keyes, Sessional Professor, Faculty of Law – Common Law Section, University of OttawaJohn Mark Keyes is a sessional professor at the Faculty of Law, University of Ottawa, and an instructor in the Legislative Drafting Program of Athabasca University. He teaches in the field of public and constitutional law with a particular emphasis on legislative drafting and interpretation. He has an LLB and a BA from the University of Toronto and a Diploma in Legislative Drafting and an LL.M from the University of Ottawa. Professor Keyes was previously Legislative Counsel in the Department of Justice (Canada) drafting regulations and government bills. He held various managerial positions and was the Chief Legislative Counsel from 2005 until 2013. He has also published many academic articles dealing with legislation and more generally public and constitutional law. In 2021 Lexis Nexis published a 3rd edition of his Executive Legislation. In 2023, Irwin Law published Drafting, Interpreting and Applying Legislation, which he co-authored with Wendy Gordon. |

Elena Bosi, Assistant Deputy Attorney General, Legislative Services (Branch), Justice & Public Safety, New BrunswickElena is originally from Moncton, New Brunswick. She holds a Bachelor of Arts degree, majoring in History and minoring in Economics, and a Bachelor of Laws degree from the Université de Moncton. She was called to the New Brunswick Bar in 2000. She has been working as a legislative counsel with the Government of New Brunswick since 2001. In 2013, she became Manager of the Francophone Legislative Drafting Section and in April 2018, she became Assistant Deputy Attorney General and Chief Legislative Counsel, a position she still holds today. She is a member of the CTTJ Advisory Committee, the Association of Legislative Counsel in Canada and the organizing committee for this conference. More proudly, she is a member of the Fredericton Indoor Tennis Club. Elena is married with two children. |
